SECTION 2: TERMS OF SERVICE

 

1. Quotations

1.1. Free Quotations. This quotation and reasonable contact time for negotiation are offered free of charge.

1.2. Standard session service. Full session of general medical practice including up to 18 face- to- face or telephone 10 minute consultation slots, associated prescriptions, drug administrations, referrals, plus consideration of up to 50 patients’ previously- authorised repeat prescriptions presented before first consultation slot.

1.3. Discounted services. Discounted services can be tailored to contractors’ needs, for example: no repeat prescribing; shorter sessions of fewer consultations. The discount is confirmed in written quotations and on the order and is therefore agreed in advance.

1.4. Extras. Extra services can be tailored to contractor’s needs, for example: visits; oncall/ duty doctor additional duties; nursing home/ ward rounds per 4 consultation slots; travel expenses beyond 30mile drive from Chesterfield. Extras are confirmed on the written quotation and the order and are therefore agreed in advance. Extras requested “on the day” may be subject to a higher level of charge

1.5. Written quotations. Written quotations valid for 60 days will be offered subject to these standard terms of service, and subject to reasonable expectations of conventional general medical practice. Tailored terms can be agreed in writing at booking.

2. Assurances. I undertake to maintain a statement of my professional status at http://www.markloveland.me.uk/

2.1. Registrations and indemnity. My registration status with the UK General Medical Council can be checked online at http://www.gmc-uk.org/ . The UK GMC may require contractors to issue certified end of placement reports in order to revalidate my registration. I undertake to pay a fee not in excess of 15 pounds sterling for each report required. My medical indemnity for work as a sessional GP is by subscription membership of the Medical and Dental Defence Union of Scotland. I have specific cover for General Practice (including dispensing) for the whole of the UK. Confirmation by writing or faxing – details at http://www.mddus.com/ . Copies of certificates available on request.

2.2. Professionalism and health. My membership of the Performers’ List of Derbyshire County Primary Care National Health Service Trust can be confirmed– details at http://www.derbyshirecounty.nhs.uk/ . I am happy to engage with any job-specific occupational health assessment or criminal records check beyond those required for the Performers’ List.

2.3. Authority to act as contractor. By signing this, you confirm that you are authorised to purchase locum services for your organisation, and make payments by electronic transfer, cheque or banker’s draft.

3. Cancellation. By booking, you agree to pay a fee in the event of cancellation. This is set at 75% of quotation fee, to be received within 30days of cancellation; where cancellation occurred more than 30days before booked date, the cancellation fee may be waived at my discretion.

Contractors can anticipate the highest standard of commitment. In the unlikely circumstances of illness or tragedy causing late notice cancellation by me, I would normally extend a 100% discount on the next locum session ordered.

4. Induction. I am computer- literate, and used to own a computer business. I am familiar with EMIS LV, PCS, Vision, Ganymede and SystemOne. I have a reasonable typing speed, and can type my own urgent referral letters on summary printouts for faxing or supplying direct to the patient. You agree to ensure that someone is available to show me local procedures if information technology is to be used. If electronic access is not able to be provided by someone at the beginning of the session, I am able to convert to paper notes for scanning. I am QOF-literate. I have designed templates or systems for heart failure, palliative care and smoking cessation. I have a “smart-card” and can interact with “Choose and book” if required. If local referral forms are preferred, please make these accessible before the first session. I will normally enquire about local emergency procedures for security, fire, child protection and first aid on arrival.

5. Inclusions. Consultations notes will include: Read-coded observations (such as blood pressure), or free text to allow later coding; record of prescription or referral; record of safety- net advice. I undertake to maintain serviceable equipment including thermometer, sphygmomanometer, ophthalmoscope, otoscope, stethoscope, and oxygen saturation monitor.

6. Exclusions. Drugs and equipment: in the event that a patient seems to require an emergency treatment (eg adrenaline) and the drug or giving equipment is not readily available, we agree that cost of restocking my bag will be borne by you. Identifying a locum/ emergency pack (including FP10 pad, Med3 pad, Headed Paper) before the session starts would be ideal. Where an organisation requires locums to carry their own stock of controlled drugs or oxygen on visits or oncall, additional fee for the administration required to secure this may apply – please highlight this when requesting quotations by ticking here []. 

7. Handovers. Consultation notes as above will include documented safety- net advice. Where there is uncertainty about the capacity of patients or carers to understand such advice, referral to a higher level of care is more likely. Where patients are advised to seek tests, advice on how they should seek results, and subsequent actions, will be documented. Where patients seem to require urgent referral before contact with their usual doctor is possible, a letter with record of fax transmission or record of postage or record of delivery to the patient will be the norm. Any few remaining non-urgent handover issues can be transmitted as preferred by you. I undertake not to take away identifiable clinical information including notes or summaries. I undertake to continue to act with due regard to the Data Protection Act and the GMC Duties of a doctor.

8. Invoices. I invoice as a sole trader and I am not registered for Value Added Tax. A written invoice will normally be presented at the end of the last booked session. For multiple bookings, an invoice at the end of the last session of the week [] or month [] may be preferred – please tick if requesting. You agree to arrange completion and return to me of the relevant parts of NHS Locum GP Pension Forms A or C at the time of invoicing, or within 2 working days.

9. Payment and late payments. I accept payment by cheque, cash, postal order (max Stlg250), BACS transfer, or banker’s draft. Payment at the end of the last booked session in response to the invoice would be most satisfactory. A signed receipt will normally be available. Late payments received more than 28days after invoice date will be subject to late-payment surcharge of additional 10% of invoice fee, or compound interest calculated monthly at Bank of England base rate +1%. By signing this agreement, you agree to this term of business. This may be waived at my discretion if payment is prompt after reminder. 

10. Complaints. In the event of your organisation receiving a complaint from a patient which implicates me, you agree to indicate this to me by email within 5 working days of your receipt of the complaint. You should anticipate confirmation of receipt within 2 working days and written response within 5 working days. In responding I will take due regard for the patient, medico-legal advice, and the reputation of your organisation and my locum service. Clinical governance via the performers’ list mechanism is available.
